Ocean County Superior Court and the New Jersey System

New Jersey has a single statewide judiciary. The Supreme Court sits at the top. Below it is the Superior Court, which has an Appellate Division and the trial divisions that hear cases in Ocean County. The trial divisions include the Law Division for civil and criminal cases, the Chancery Division for general equity and the Family Part, and the Probate Part. Ocean County is Vicinage 14, run from the courthouse and Justice Complex in Toms River. The Trial Court Administrator is Jill Vito.

The Civil Division splits cases by amount. Cases over $20,000 go to the Civil Division. Cases over $5,000 up to $20,000 go to the Special Civil Part. Claims of $5,000 or less are small claims. General Equity hears foreclosures, trade-secret disputes, and emergency relief. Below the Superior Court, Municipal Courts handle nearly six million cases a year across the state.

Public Access Laws for Ocean County Court Records

New Jersey uses two records frameworks, and they do not overlap. County agency records, such as Clerk and Sheriff files, fall under the Open Public Records Act (OPRA). Court case files are different. The judiciary is not a public agency under OPRA, so case records follow Court Rule 1:38 and NJ Courts procedures instead. Knowing which rule applies tells you where to file the request.

Key Statutes:

N.J.S.A. 47:1A-1 et seq. (OPRA) - sets the public right to access government records held by county and local agencies.

New Jersey Court Rule 1:38 - governs public access to court records and lists the records that are excluded.

N.J.S.A. 9:3-51 and 9:3-52 - seal adoption records, which can be opened only by a Superior Court order.

The Government Records Council handles OPRA denials, but it has no power over court files. For agency records, the usual OPRA response time is seven business days.

Records That Are Restricted or Confidential

Not every Ocean County case document is open to the public. Court Rule 1:38 and several statutes keep some records private. Juvenile delinquency records are restricted. Adoption records are sealed. Divorce documents are released only to a party or attorney of record unless a court orders otherwise. Domestic violence victim details, mental health and civil commitment records, grand jury materials, and expunged cases are all kept out of public view.

To view a sealed record, you usually need a court order. Expungement is its own Superior Court process. Once a case is expunged, it is removed from public court records and does not have to be reported for most jobs, housing, or school applications. Law enforcement and the courts keep limited access for narrow legal reasons.

Specialty Courts in Ocean County

New Jersey runs Recovery Court, once called Drug Court, for eligible defendants with substance-use disorders. The program uses judicial monitoring, probation supervision, treatment, drug testing, and graduation after sustained progress. The Ocean Vicinage lists a Recovery Court line at 732-504-0700, ext. 64242. It is not a public search portal, and treatment information stays protected.

Municipal cases also have a resolution path. Through NJMCDirect, a person can request a plea agreement from the municipal prosecutor for certain charges. The State Parole Board runs Veterans Initiatives, and the Ocean County Prosecutor's Office runs a Special Offenders Unit. A dedicated Ocean County mental health court page was not found in official sources.

Ocean County Sheriff and Jail Information

Ocean County splits its sheriff and jail duties. The Ocean County Sheriff's Office, led by Michael Mastronardy, handles court security, warrants, field services, civil process, and transport. The Ocean County Department of Corrections runs the jail and is the main custodian of adult offenders arrested in the county. The jail sits at 114 Hooper Avenue in Toms River, and its inmate line is 732-929-2043.

You can look up people in custody with the Ocean County Inmate Lookup Tool. The screenshot below shows the criminal public access portal that the county's Superior Court cases feed into.

The NJ Courts copy fee schedule applies when you order court records through judiciary channels. Plain copies cost little. Certified and exemplified copies cost more because they carry the court's attestation. Pay by check or money order to Treasurer-State of New Jersey, or pay cash in person.

Plain copy, letter size$0.05 per page
Plain copy, legal size$0.07 per page

Surrogate and County Clerk records carry their own fees, which are listed on those office pages.

How to Interpret Ocean County Court Records

New Jersey docket numbers carry meaning. The prefix tells you the case type. L marks a Law Division civil case. LT marks landlord-tenant. DC marks Special Civil. SC marks small claims. F marks foreclosure. FM or M marks dissolution, which is divorce. The two-digit year and the county code 15 for Ocean are built into the number.

Read a charge as an accusation, not a result. A charge means the state alleges an offense. A conviction means a court found guilt or the person pleaded guilty. The disposition field shows the real outcome. A case can be dismissed with prejudice, which usually blocks refiling, or without prejudice, which can allow it. When in doubt, the docket entries and the final judgment carry the answer.

Accuracy and Record Limitations

Online court data can lag behind the courtroom. Entries are added after filings are processed, so a recent event may not show right away. Older judgments docketed before February 1984 were indexed by hand and are not in the online judgment system. Those need an in-person or staff search.

Note: Confirm any case detail with the originating court division or office before you rely on it for legal, financial, or filing decisions.

History of Ocean County Courts

Ocean County was set off from Monmouth County on February 15, 1850, as New Jersey's twentieth county. The first freeholders met in Toms River and quickly resolved to build a courthouse and jail. The 1850 Ocean County Court House at 118 Washington Street still stands. It is a Greek Revival brick building with six Doric columns and a pedimented portico, listed on the National Register of Historic Places in 1983.

Court work later spread into the modern Justice Complex, which houses 25 Superior Court judges and several courtrooms. The Clerk and Surrogate stayed tied to the courthouse, keeping the old link between court filings, land records, and probate. Today the public's first stop is often an online portal rather than a courthouse counter.
