New Jersey's Split Clerk Structure
New Jersey separates court clerk functions from county clerk functions more sharply than most states do. The two offices are different in every way: different legal authority, different records, different offices, and different request workflows. Getting the wrong office means a delay. Getting the right one means a faster response.
The Superior Court Clerk's Office (SCCO) is a statewide judiciary office. It manages closed civil, criminal, divorce, family, special civil, foreclosure, general equity, judgment, and statewide judgment lien records for all counties. Its customer service line is 609-421-6100 and it is based in Trenton. Open-case records for pending Ocean County cases stay at the local Superior Court division in Toms River until the case closes and the file is transferred or archived.
The Ocean County Clerk is an elected county official. That office handles land records, elections, passports, notary services, veteran cards, trade names, property alerts, and document recording. Court case files are not part of the County Clerk's duties. If you need a deed, a recorded mortgage, or an OPRA request for a county agency record, the County Clerk is the right office. If you need a certified copy of a court judgment, a divorce decree, or a case file, keep reading.
New Jersey Court Rule 1:38 governs access to court records. OPRA, which covers most county agency records, does not apply to the judiciary. The Government Records Council confirms that the judicial branch is not a public agency under OPRA and operates under its own disclosure rules.
The Superior Court Clerk's Office and SCCO
The NJ Courts copies of court records page is the central resource for understanding how record requests flow through the statewide Superior Court Clerk system. SCCO handles a wide range of closed and archived case types regardless of which county the original case was filed in.
According to NJ Courts, open cases are processed by the county Superior Court division where the case was heard. For open statewide judgment liens and foreclosure records, the processing location is SCCO. For closed civil, criminal, divorce, family, and special civil records, the division is also SCCO. For archived civil, divorce, foreclosure, general equity, judgment, and statewide judgment lien files, choose SCCO even if the case was originally heard at the Ocean County courthouse. This routing logic is critical when you fill out the records request form, because choosing the wrong processing location delays or voids the request.
Divorce records deserve a specific note. Ocean County's divorce inventory year in the NJ Courts Dissolution Files Inventory is 2011. That means divorce cases up to and through that year are stored at SCCO's records warehouse in Trenton. If the docket number is unknown, call SCCO customer service at 609-421-6100. A search can be done if the caller provides the county, approximate filing year, and names of the parties. Divorce documents are released only to a party or attorney of record unless a court order directs otherwise. The requesting party must include a valid state-issued photo ID.
Records from SCCO are emailed to the address provided on the request form after processing. Payment is by check or money order made out to Treasurer-State of New Jersey, or by cash for in-person requests. Attorneys may use a Superior Court Attorney Collateral Account (JACS).

Ocean County Court Records the Clerk Handles
Superior Court Clerk functions in New Jersey cover a broad range of civil and criminal case records. The division offices in Ocean County process open cases while SCCO archives and stores closed files. Both sides of the clerk function touch every major record type that the Superior Court generates.
Civil records include complaints, answers, motions, orders, judgments, writs, and satisfaction filings for cases involving accidents, contracts, malpractice, and landlord-tenant disputes. Cases over $20,000 in controversy sit in the Civil Division. Cases between $5,001 and $20,000 go to the Special Civil Part. Small claims at or below $5,000 also route through Special Civil. Judgment lien records and statewide judgment lien certificates are available through SCCO.
Criminal Division records cover adult indictable cases, including complaint-warrants, complaint-summons filings, indictments, accusations, plea forms, motions, judgments of conviction, sentencing orders, and post-conviction filings. Family Division records include dissolution (divorce) filings, custody orders, child support, domestic violence restraining orders, and related pleadings. Access to family records is limited. Divorce files go only to a party or attorney of record.
Foreclosure and general equity records flow through SCCO for archived matters. The General Equity division in Toms River handles open foreclosures and injunctive matters before they close and archive. Tax Court records involve property and state tax appeals and are a separate statewide court. For probate records such as wills, letters testamentary, and guardianship matters, the Ocean County Surrogate's Court handles those filings at the courthouse, not the Superior Court Clerk.
- Civil and special civil - money disputes, landlord-tenant, small claims, judgment liens
- Criminal - indictments, plea records, judgments of conviction, post-conviction filings
- Family / dissolution - divorce decrees, custody orders, child support, restraining orders
- General equity and foreclosure - equity proceedings, emergency relief, mortgage foreclosures
- Judgment and lien records - statewide judgment lien certificates, civil judgment docket entries
How to Request a Certified Copy
Certified copies carry the court's attestation and seal. They are accepted in legal proceedings, real estate transactions, immigration filings, and any process where an official record must be proven. A plain copy costs much less but lacks the court's certification and is not accepted as evidence in most legal contexts. An exemplified copy adds a judge's certificate and is used for out-of-state filings. Use the copy type that fits your purpose.
All requests for Ocean County Superior Court case copies use the NJ Courts records request workflow, with submissions through the electronic document submission (JEDS) system or by mail. Records are emailed back to the address on the form after processing.
- Identify the case and docket number. Ocean County's county code in the NJ system is 15. Docket prefixes vary by case type: L for Law Division civil, FM or M for dissolution/divorce, F for foreclosure, DC for special civil, and SC for small claims. If you do not have the docket number, call SCCO at 609-421-6100 with the county, approximate filing year, and party names.
- Determine the processing location. Open cases route to the Ocean Vicinage division where the case is currently pending. Closed civil, criminal, divorce, family, and special civil cases route to SCCO. Archived civil, foreclosure, general equity, and statewide judgment lien files also route to SCCO. Selecting the wrong location on the form causes delays.
- Download and complete the NJ Courts records request form from the NJ Courts copies of court records page. Fill in every required field. Include a copy of your valid state-issued photo ID if the record is restricted to parties or attorneys, such as a divorce file.
- Select the copy type. Options include plain copy, certified copy, seal of the court, exemplified copy, triple exemplified copy, certificate of statewide judgment lien, certificate of divorce, or certified final judgment of divorce. Each carries a different fee from the NJ Courts schedule.
- Submit the form and payment. Submit through JEDS or by mail. Checks and money orders go to Treasurer-State of New Jersey. Attorneys may use a JACS account. Cash is accepted in person only.
- Receive records by email. NJ Courts states records are sent electronically to the email provided on the form. Confirm your email address is correct before submitting.
Records Request Information Needed
The NJ Courts records request form and the JEDS submission process require specific identifying details about the case and the requester. Leaving fields blank or choosing the wrong processing location are the two most common reasons for delays. The table below shows what to gather before you start.
| Field / Information | Required | Notes |
|---|---|---|
| Case / docket number | Yes (if known) | Include docket prefix (L, FM, F, DC, SC, etc.) and the county code 15 for Ocean. If unknown, call SCCO at 609-421-6100. |
| County | Yes | Ocean County; NJ Courts county code 15. |
| Court / division | Yes | Select the correct division: Civil, Criminal, Family, General Equity, Special Civil, or statewide SCCO for closed/archived records. |
| Processing location | Yes | Ocean Vicinage for open cases; SCCO for closed, archived, and statewide judgment lien/foreclosure records. This is the most critical field to get right. |
| Party names | Yes | Full names of plaintiff/petitioner and defendant/respondent as they appear on the case. |
| Copy type requested | Yes | Plain, certified, seal, exemplified, triple exemplified, certificate of divorce, certified final judgment of divorce, or judgment lien certificate. |
| Number of copies | Yes | Specify exact count; fee multiplies per copy. |
| Requester name and email | Yes | Records are emailed back to the address on the form. Verify the email address before submitting. |
| Valid state-issued photo ID | Conditional | Required when requesting divorce files or other records restricted to parties and attorneys. Include a copy with the form. |
For civil case jacket searches, the official public access system also accepts party name, judgment number, county and court selection, and case type. See the Ocean County court records page for full portal search-field details and the Civil Case Jacket Public Access link.
Copy and Certification Fees
NJ Courts publishes a fixed fee schedule for all Superior Court copy requests. Fees apply statewide; Ocean County cases use the same schedule as every other New Jersey vicinage. Plain copies cost the least and carry no certification. Certified copies add the court's attestation and are required for most legal uses. Exemplified and triple exemplified copies carry additional judge certification for out-of-state recognition. The certificate of divorce confirms the case closed but does not reproduce the full judgment; the certified final judgment of divorce reproduces and certifies the actual judgment document.
| Copy / Service Type | Fee |
|---|---|
| Plain copy, letter size | $0.05 per page |
| Plain copy, legal size | $0.07 per page |
| Certified copy | $15 |
| Seal of the Court | $10 |
| Exemplified copy (plus plain copy fees) | $50 |
| Triple exemplified copy | $60 |
| Certificate of statewide judgment lien | $10 |
| Certificate of divorce | $10 |
| Certified final judgment of divorce | $25 |
Pay by check or money order made out to Treasurer-State of New Jersey. Cash is accepted in person only at a courthouse window. Attorneys may pay through a Superior Court Attorney Collateral Account. Pre-printed checks only; no checks without a printed bank account number. Surrogate and County Clerk records have separate fee schedules published on those office pages.
Closed and Archived Records Through SCCO
Once an Ocean County Superior Court case closes and passes through the county-level retention period, the file transfers to the SCCO warehouse in Trenton. This is not just a backup system; it is the official custodian of the record from that point forward. Archived files are not retrievable through the county division offices in Toms River, and asking the local division for an archived file will simply redirect you to SCCO.
SCCO handles archived records across all case types: civil, divorce, foreclosure, general equity, judgment, criminal, special civil, and statewide judgment lien records. The Ocean County dissolution file inventory year is 2011, meaning that divorce cases through that year are in SCCO custody. For cases filed after that year, check first with the Ocean Vicinage division to confirm where the file currently sits before submitting a records request.
Older civil judgments are a special case. Judgments docketed before February 1984 were indexed by hand and are not in the electronic judgment system. Searches for these require an in-person visit or a court staff search at SCCO. Do not expect online results for pre-1984 civil judgment records.
SCCO customer service can confirm whether a specific Ocean County case is at the county level or in SCCO custody. Call 609-421-6100 before submitting a records request if you are unsure of the processing location. Choosing the wrong location on the form adds processing time and may require resubmission.
